Rule 101-03 is amended to include a new initial registration fee of $3,250 and a new renewal registration fee of $3,185 for course providers.
Rule 105-03 is amended to improve compliance by course providers. Specifically, the rule:
• Creates a registration for course providers as of July 1, 2025 and subjects them to the suspension and revocation provisions of Section 28-401.19 of the Administrative Code.
• Provides that course provider approvals issued prior to July 1, 2025 will continue to be valid and that course providers may continue to offer Department-approved courses after July 1, 2025, provided they submit an application to register by June 30, 2025.
• Adds language about investigations and audits.
• Provides guidance on how to conduct non-traditional course/class formats.
• Removes sections that are no longer relevant because the deadlines have passed or the described processes are no longer followed.
• Creates a requirement for providers to upload data to DOB’s online platform.
• Adds a requirement that a course provider upload certificates of completion prior to withdrawing from the course provider program.

Since I have taught various SST courses and other related NYC-DOB courses, these are my comments:
a) Amend as follows: “Requiring the imposition of registration fees. Under section 1 of this proposed rule, Rule 101-03 is amended to include a new initial registration fee of $6,700. and a new renewal registration fee of $4,200.
b) Under section 2, Rule 105-03 is amended to improve compliance by course providers. In order to eliminate the fraud, NYC-DOB should consider these additional requirements:
i) the course certificate should be signed by the instructor or instructors since the instructor (s) are responsible meeting NYC-DOB established courses curriculum.
ii) the course certificate should state the language that the class has been taught including all related documents (PPT, videos and hands-out, etc.)
iii) no class should be taught over 8-hours per day (contact hours 7.5 hours as OSHA OTI has established many years ago.)
iv) no 10-hrs class in one day or no 40-hrs class in 4-days.
v) certain courses such as HMO, 40-hrs SSM should be taught in person rather than ZOOM since these requires the instructor have quizzed the attendees for the knowledge of law (recent fatality of improper use of lifting equipment confirm my concerns).c) 105-03.(b).(1).(iii) should require that the instructors CV and their experiences should be as part of the approval for the provider. The NYC-DOB investigator can audit or interview the instructors for their knowledge and in the case of offering in other languages than English, the instructor should be interviewed randomly and ask to provide NYC-DOB Investigation team course materials, videos, PPT and etc in the language he or she is teaching.
I have more comments unfortunately I have been dealing with a major health issue in the past three months. I will add further comments prior to the deadline. These changes may stop the existing frauds.
