Adopted rule summary:

The New York City Department of Health and Mental Hygiene adopted to repeal and restate Chapter 12 (Window Guards) of Title 24 of the Rules of the City of New York (“RCNY”) in order to provide updated window safety requirements applicable to modern window types, eliminate the need for a Window Guard Policy and Acceptance Board, and introduce a more efficient process for manufacturers seeking approval of window fall prevention devices. No one testified at the hearing. Two written comments were received.

    Just curious. If the window guard and lead forms are required on lease renewal why do they also have to be sent separately in January? That’s twice a year. Most small landlords already know exactly how many kids and what ages they are in their rental units. Maybe this should be directed at larger landlords who can’t track that while landlords with 10 or fewer units should be exempt. Most tenants think it is obsessive to repeat the forms more than once a year.

    Why is the City making it an owner’s responsibility for what is a parents/tenant’s responsibility. If we provide window guards at move-in, why do we have to be held accountable for tenants that illegally remove them. Same for Smoke/CO detectors. The City hits us with violations for what is the reusability of the occupant. The lease holder should be the one that gets the violation. It’s extortion, and it needs to stop!
