Adopted rule summary:

The Department of Environmental Protection is adopting new rules to implement Section 1043(g) of the New York City Charter, which permits any person to petition a city agency to consider the adoption of any rule and requires each agency to have rules creating a procedure for such petitions.

    In the proposed rule, it is not clear what “the email address
    identified on the Department’s website” is.

    Please specify a specific DEP email address, in the rulemaking
    petitions rule, to which rulemaking petitions should be sent.

    Proposed section § 60-04(b), “the Department will” should instead read “the Department shall.” It is unclear what favorable purpose the more-relaxed “will” language serves. As stated in the Notice, “shall” and “must” denote mandatory requirements; the Department’s response deadline should be a mandatory one. (As far as I can tell, “will” is not a defined term)
