The Department of Environmental Protection is proposing to amend its rules to provide a procedure for public hearings regarding objections to variance applications filed pursuant to section 24-110 of the Administrative Code.

Rather than proposing a rule that concerns only the public comment portion of the variance petition process, the Department should craft a holistic rule that provides standards and procedures encompassing each interlocking component of the whole process. For example, there is presently no rule concerning the types of proofs required of the petitioner; the form of the petition; the Commissioner’s consideration of the petition; or any other aspect of the petition process. The public comment portion of the petition process should not be considered in a vacuum.
