The proposed rule would amend sections 4-01 and 4-12 of Chapter 4 of Title 34 of the Rules of the City of New York (“34 RCNY”) to prohibit property other than bicycles and scooters from being attached to City-owned bicycle racks.

Comment added April 24, 2026 11:45amThe regulation should require the City to
1) allow bicycle owners to submit a report responsive to a notice affixed to their bicycle that the bicycle has moved and should not be subject to removal.
2) post signage or stickers on the racks or on sign posts within 50′ either direction of the rack indicating the time limit
3) verify that the bicycle has not been moved from the subject rack by photographic the exact location of the bicycle on the rack and the manner of securement of the bicycle to the rack. This is necessary because someone living or working near a rack may regularly return their bicycle to the rack and repeated observations by the City at similar times of day, days of week may observe the same bicycles secured to the rack even though they are not continuously secured to the rack.
4) make observations on at least two different days of the week at two different times of day separated by at least 6 hours
5) allow for submissions of photos taken directly through the 311 app
6) suspend this regulation (pause tolling of days) on days with more than 1 hour of rain, for 7 days following the last snow removal operation by the Department of Sanitation, and for 21 days following any snow event or removal operation which causes the bicycle rack to become inacessible due to snow and ice accumulation or placement of snow or ice in the bicycle rack.
