The New York City Board of Correction (the “Board”) is proposing to amend §§ 205(b)(2)(i-ii) and 3-04(b)(2)(v)(A) of Title 40 of the Rules of the City of New York (“RCNY”), on psychotropic medication and tuberculosis screening, respectively, to codify longstanding variances. The Board also proposes to amend Chapters 2 and 3 of Title 40 of the RCNY (hereinafter referred to as the Board’s “Minimum Standards” or “Standards”) to correct outdated language, such as references to “inmates” and “Department of Mental Health, Mental Retardation and Alcoholism Services,” align variance procedures across all sections of the Standards, and remove references to seclusion.

Mental Health and Health Care is a concern in every state NOT just in New York City and state of New York. These incarcerated individuals to need to be under the Mental Hygiene Parity Act, which No one is denied treatment. Also the Treatment Court Expansion Act needs to be passed in Albany because for 6 yrs it has NOT been implemented. These individuals some MICA patients need Medical Professional Treatment! What is the point of the Mental Hygiene 94.3 in Civil Court? When an individual is NOT compliant with their meds and DON’T have an intense support team to re enter our communities PRODUCTIVELY!! With the mindset they have abnormal behavior, committing petty Non Violent crimes and placed in Criminal Court with extra charges against them , pressed to take a plea in competent mindset. If it is a Violent crime the root of the problem must be taken into consideration!! These individuals need to be Educate about their illnesses and disease!! Being incarcerated is unsafe and unhealthy, how can they FOCUS being distracted hearing voices, worried about their well being, being isolated and confined that’s making their mindset worse, especially, if given the incorrect dosage of meds, they DON’T trust no one..etc..its just horrible being abused and intimidated by some Correctional Officer because they are NOT trained to deal with an individual with Mental Health concerns or a MICA patient. These individuals are human and are struggling and need Professional Medical support team who really care to make a change in Mental Health and Health Care!!
