This rule would amend and expand the Department of Sanitation’s (“Department”) stationary on-street container program to include three additional areas in which both large residential buildings that contain 31 or more residential dwelling units, and medium residential buildings that contain 10 to 30 residential dwelling units would be required to containerize. The existing rule designated Manhattan Community District 9 and Brooklyn Community District 2 as pilot areas where buildings with 10 or more dwelling units were required to containerize all trash.

The City Council passed Local Law No. 180 of 2025, which authorizes the Department to expand this program and gives the Department additional authority to promulgate rules related to containerization and the use of stationary on-street containers. Based on the success of this program in the pilot areas, the Department is making this program permanent.

The expanded permanent program will include the following community districts:
• Manhattan Community District 9 and Brooklyn Community District 2, which must continue to containerize,
• Bronx Community District 2, Bronx Community District 5, and Queens Community District 2, which must use stationary on-street containers by June 30, 2027, or on the date in which such stationary on-street container is installed, whichever is earlier, and
• Medium residential buildings in these new community districts can opt-in to using stationary on-street containers from January 2, 2027 to March 1, 2027, and must either begin using rigid containers with tight fitting lids by June 30, 2027, or stationary on-street containers by June 30, 2027, or on the date in which such stationary on-street container is installed, whichever is earlier.
