The proposed amendments would expand the categories of illegal behavior for which the Department’s Enforcement Officers can issue a notice of violation (sometimes called a summons) in order to protect the natural environments under the jurisdiction of the Department and increase the penalties associated with certain violations. Among other rule changes, the rules propose to increase the fines for illegal dumping.

The proposed increased penalties come in response to the prevalence of illegal dumping in parks and the growing concerns about the impact of illegal dumping which not only mars the natural beauty of our parks but also poses risks to the local community. These proposed new rules aim to deter would-be offenders and encourage a culture of respect and stewardship towards our public spaces and underscores our commitment to preserving the beauty, cleanliness and health of our parks and public spaces.

Additionally, while the abandonment of animals and the collection of bivalves are both currently prohibited under State law and can be enforced by Parks, having a new City rule would help further discourage this behavior and make it easier for Parks to issue summons for these activities using Parks codes.

    The Mayor’s Alliance for NYC’s Animals is a 501 c3 non-profit charity that provides information about resources and services for NYC’s pet owners and anyone looking to help improve the lives of NYC’s animals. We support the proposed amendments to expand the categories of illegal behavior for which the Department’s Enforcement Officers can issue a notice of violation for illegal dumping and abandoning animals. Further, we urge that the amendments include language that provides for public education informing people about the alternatives to abandoning animals, including surrendering them and/or seeking surrender prevention assistance at one of the many shelters and rescue groups in our community. Greater understanding of these surrender and surrender prevention options can help deter people from abandoning animals in parks and other public spaces and result in more positive outcomes for the animals and the public.
