Adopted rule summary:

In compliance with section 1043(b) of the New York City Charter (“the Charter”) and pursuant to the authority granted to the New York City Board of Health (“the Board”) by section 558 of the Charter, a notice of intention (“NOI”) to amend Article 203 of the New York City Health Code (“Health Code”) to align it with portions of recent legislative changes to Article 41 of the New York State Public Health Law, regarding reporting pregnancy loss and induced terminations of pregnancy, was published in the New York City Record on November 19, 2025. A public hearing was held on December 19, 2025, and one person testified at the hearing. An additional seven written comments were received. At its meeting on May 19, 2026, the Board adopted this resolution.

    As a family physician and abortion provider in New York state, I strongly support removing reporting requirements for abortion and miscarriage care in our state. These requirements raise patient concerns for confidentiality (even if anonymous, there is always a concern when sensitive data is being tracked) and are a burden for providers, especially those in smaller offices without dedicated staff for reporting. Similar data is already available through other avenues, so I see no reason not to remove reporting burden and threat of loss of continuity.

    I strongly support eradicating all collection of data related to abortion services. In this age where privacy is essential, collecting more information can be quite damaging to patients, clinics and doctors alike. There are many ways other than abortion reporting to collect information that can guide allocation of resources. I am sorry that I was unable to connect on the zoom hearing. The link was not working.

    Since 2021, Hey Jane has provided telehealth abortion care to over 100,000 patients, including many with shipping addresses in New York City. Hey Jane strongly supports the Proposed Amendment to Article 203 of the New York City Health Code. Hey Jane appreciates the Department’s commitment to public health and applauds its work on this Proposed Amendment.
