The New York City Department of Health and Mental Hygiene is proposing that the New York City Board of Health amend Article 173 of the New York City Health Code to update the definition of “lead-contaminated dust” based on recent changes made by the U.S. Environmental Protection Agency (“EPA”) to its rules.

Comment added June 3, 2026 5:34pm1.) Baseline concentrations of elemental lead in lots, gardens, sidewalks and streets of the boroughs of NYC can often exceed 4ug/ft2.
2.) Who will be collecting these baseline samples? Solely EPA certified Risk Assessors should perform this work.
3.) Project Completion/Verification via dust wipe clearance to be performed by independent third party licensed/insured EPA Region 2 certified.
4.) which methods are acceptable and preferred? HUD Guidelines or ASTM for wipe collection.
5.) will department furnish a list of acceptable wipe media; e.g ghost wipes, etc.
