The Office of Administrative Trials and Hearings (“OATH”) proposes to amend section 6-17(b) and (c)(2) of Title 48 of the Rules of the City of New York (“RCNY”). This proposed rule would clarify that, where the Department of Consumer and Worker Protection (“DCWP”) is the Petitioner, adjudicated violations of Article 13-F of the New York State Public Health Law would no longer be treated as recommended decisions. Instead, decisions by OATH Hearing Officers will be final, unless an appeal is filed pursuant to 48 RCNY § 6-19.
