The proposed rules amend Chapter 50 of Title 28 to (1) incorporate the building service employee requirements applicable to Affordable Housing from Commercial Conversion (AHCC) Program Benefits and Affordable Neighborhoods for New Yorkers (ANNY) Program Benefits recipients into the current regulatory framework, (2) specify the sanctions and revocation procedures that are unique to these new programs for violations of the prevailing wage requirements, and (3) articulate the exemptions from the building service employee requirements for AHCC Program Benefits and ANNY Program Benefits recipients.

32BJ SEIU submits the attached comments in support of the Department’s proposed rules: (1) clarifying that provision of a dwelling unit is not considered a bona fide fringe benefit for the purposes of the prevailing supplements requirement; and (2) specifying the sanctions and revocation procedures under the ANNY and AHCC programs for violations of the prevailing wage requirements.
