Rules implementing new legislation which establishes an owner's responsibility to investigate for and remediate indoor allergen hazards. The proposed rules provide for work practices to be used by owners to remediate these conditions, forms for providing notices to tenants, and procedures for submitting certifications of correction of violations of the law.

HPD’s rule exempts motels and tourist cabins from the replacement ratio requirement. Thus, if there was a motel or tourist cabin on the eligible site three years prior to the commencement date, the motel rooms or tourist cabins that were demolished, removed or reconfigured would not each have to be replaced with an affordable housing unit.

The proposed rules implement and clarify new legislation providing for a pilot program which requires owners of certain buildings to apply for a certification of no harassment from the Department of Housing Preservation and Development when they apply for a permit to perform certain kinds of work in the building.

HPD’s rule amendment updates the MIH Affordable Housing Fund contribution schedule for the coming fiscal year (July 1, 2018 through June 30, 2019). In addition to changes in the contribution amounts, the rule amendment moves Queens Community District 6, which includes Forest Hills and Rego Park, from Fee Tier 3 to Fee Tier 4, in order to reflect changes in the relative market characteristics of that Community District.
