The New York City Police Department is proposing to update the Department’s rule requiring electronic recordkeeping for purchases and second-hand sales of certain goods, and the uploading of such records to a web-based electronic data transfer service. On December 22, 2022, Local Law 123 of 2022 became law, which adds the purchase of catalytic converters to the list of second-hand goods subject to these requirements under Title 38, Chapter 21, Section 21-04 of the Rules of the City of New York.

Notice of Cancellation of Public Hearing and Opportunity to Comment on Amendment of Rules

The NYPD was scheduled to hold a public hearing via Zoom on June 16, 2023, at 10 a.m. regarding a proposed change to the Rules of the City of New York. The proposed change would include catalytic converters among the items which are subject to certain record-keeping requirements for dealers in second-hand items. Due to unforeseen technical problems, the hearing could not proceed as scheduled and has been cancelled. It will be re-scheduled in the near future.

    When Administrative Code Local Law 149 was adopted, in June, 2017 we pursued to NYPD’s Legal Division, on behalf of licensed NYS. Dept. of Motor Vehicle dismantlers and scrap processors, inquiring whether this law was applicable to Scrap Metal Processors and Department of Motor Vehicle Dismantlers, since they were always required to keep records of major components parts for the NYS Dept. of Motor Vehicles, which now includes catalytic converters. Vehicle dismantlers must also possess a Second Hand Dealer – General license from the NYC Dept. of Consumer & Worker Protection. This license also requires these businesses to maintain records.

    On June 15, 2017 Robert Barrows, NYPD Managing Attorney, Legislative Affairs Unit responded to our inquiry (copy attached) and stated “As such, scrap processor, salvage yards business that buy and sell used cars and used car parts are not subject to reporting into Leadsonline pursuant to Local Law 149. UMOS, however, are reminded that as a condition of possessing a second-hand dealer license issued by DCA (“now DCWP”) these businesses must still maintain written records of their purchases and sales. Additionally, these businesses may voluntarily elect to upload information into Leadsonline.

    It is respectively requested that an exemption for vehicle dismantlers and scrap metal processors be stated somewhere in your rules. At the present time NYC DCWP inspectors are going around to vehicle dismantlers requesting proof of their participation in Leadsonline and threatening violations, when your agency that oversees this law states it is not required. Thank you.

    To put a stop to catalytic converters theft, I belive the owners of car repair shops/garages/gas stations/etc who purchase and resell stolen catalytic converters should be held accountable and face steep fines and/or revocation of their business operating license.
